TEARS, FEARS AND JUSTICE

Thirteen years ago, a brave man by the name of Enyang Anak Gendang perished tragically when he was shot dead by Police Field Force Personnel (PFFP) on Dec 19, 1997, at his Rumah Bangga longhouse in Sungai Sebukut, Bakong in Baram, in front of his wife, their relatives and and the longhouse community.

Free Malaysia Today reported HERE that the court yesterday awarded Endu Mit Anak Egut victory over the government of Malaysia and the police who had robbed her of her husband and life support. Kudos to the dogged determination of his widow to seek justice for her late husband's untimely demise. Endu sued the PFFP and the government for damages for wrongly or negligently shooting her husband which had caused his death. Enyang was 46 years old then.

The report said that Endu was awarded damages and loss of support after the court found the PFFP negligent in shooting her husband and ordered the government of Malaysia as employer of the PFFP to pay her and her two children. The court ordered the government to pay Endu RM70,000 for loss of support. It also awarded her damages of RM100,000. The court also ordered the government to pay costs to her.

Endu's counsel for the case is Harrison Ngau whom I worked with in my first job as a writer with a NGO almost three decades ago. Then and even now, Harrison has not wavered in his fight for justice and in defence of NCR and other issues plaguing Sarawak.

Their fight is truly an inspiring one. Despite the tears for the loss of Enyang's life, despite the fears of the seemingly insurmountable obstacles they faced, they put aside their fears and tears to soldier on relentlessly for justice.

Together with the others who were injured in that incident, I regard Enyang, Endu, Harrison and their longhouse kinsfolk as heroes who have the courage, perseverance and vision to hold steadfastly to what they believe is theirs in their fight for justice and in defence of their land.

Enyang Anak Gendang, you will be forever remembered by your family, your longhouse kinsfolk and many other Sarawakians.


May Enyang's soul rest in peace now and may more Ibans and Sarawakians rise up to fight for what is rightfully theirs. They have to put in place a government that respects NCR and cares for the welfare of Sarawakians. Once that is done, not only will their welfare be taken care of but the journey to Putrajaya will be smoother. Together, we CAN!!!

    Anonymous May there arise more of the "Enyang" type of people who will stand against the tyrant. The fact that the court's decision is for the late family of Enyang, we should not be grateful. The wrongs done to these natives cannot be brushed aside by the mere award.

    A life is lost and a family broken up just because the law of the land became laws of the jungle. Besides the compensation, was there any charges for the MUDERER/S out there ? Maybe that sane guy/s had even been promoted as he sides with the logging company then, just maybe, ya.

    In any case, please be reminded that the court of appeal can still rule otherwise as they are the "wisest" of this land. There are many more deaths due to the underhanded tactics by those in power and we should be angry enough to get those responsible to face justice.

    Only a change in current govt and all the bn's friendly court officials will we see true justice as it is. One step at a time. Get them voted out first and the rest will falls into place. On your mark, get set, go. The race ahead isn't easy but if we do not even get onto the track how to taste the end result.

    Let us all be a doer than being mere spectator. Contribute in ways we can like getting all known relatives to be registered as voters. Ensure more voters know their rights and vote only those that are for the people. Send those racist out to pasture and this former land of milk and honey will be duly restored.

    Justice On Holiday I'd hate to be a bucket of cold water but a victory after 13 years in court isn't really a victory. the apathy of any enforcement agencies coupled with an indolent judicial system is never a victory for the people of any country.

    trigger happy police officers are as much a danger to the society as criminals because of the blatant disregard of human life. take away the badge and he/she is just another sociopath with a firearm. this is another example that our law enforcement system has already broken down many years ago. justice is long gone and this is the sad reality for us.

    Thank you for writing with so much compassion and empathy for Enyang's family and community.

    You have raised pertinent questions that demand answers but whether or not we will get them is another issue.

    Indeed the only way out seems to be change effected via the ballot box and I pray Malaysians will really rise to the occasion and vote wisely this time and not think that their vote matters not!

    Your nom de guerre is a grim reminder of reality. Thank you for calling a spade a spade. The time span of 13 years speaks volumes about many issues like what you have eloquently expressed in a very empathetic manner.

    The fact remains that we face a sad reality and that is why we can be silent no more. Let us all speak up in the next GE.

    Yes 13 years is a very very very long time & to be awarded only RM170k is a joke.

    It is because the widow & family are not considered real people nor real anak buah Malaysia even what's worse the tag of "orang asli" is an excuse to plunder,rape,pillage,main,trample & kill!

    And what happened to the "killer"? - should not the PDRM upon investigation, immediately 13years ago paid out a very handsome sum and ensured that the widow & family were looked after?

    Sheesh!
